Whistleblower Letter, Alleged Quid Pro Quo Dominate 3rd Circuit Pick Bove’s Confirmation Hearing - Law.com

During a hearing spanning nearly three hours, Senate Judiciary Committee Democrats on Wednesday grilled federal appeals court nominee Emil Bove on allegations he steered prosecutors to drop corruption charges against New York's mayor as part of a quid pro quo and on a whistleblower's claim that Bove advocated ignoring court orders in immigration cases.

President Donald Trump’s pick for the U.S. Court of Appeals for the Third Circuit refused to answer a Democratic senator’s question on whether he consulted with the president or White House officials in advance of the U.S. Justice Department’s move to dismiss corruption charges against New York City Mayor Eric Adams.

Bove, currently principal associate deputy U.S. attorney general, told Sen. Richard Blumenthal of Connecticut that he was “not going to describe the participants in conversations.”

Blumenthal, in pressing Bove on whom he spoke with, referenced the nominee's memo directing prosecutors to drop the charges.

“No, I will not say,” Bove, who previously defended Trump against hush money charges, responded when asked if he spoke to presidential adviser Stephen Miller before moving to dismiss the charges. “It is not appropriate for me to discuss.”

In declining to answer the question, Bove said he was responding in a similar fashion as previous judicial nominees and pointed to current D.C. Circuit Judge Gregory Katsas, who served as deputy White House counsel and assistant U.S. attorney general before his appointment.
