Whistleblower Protection Act - Lexology

On 27 January 2023, the National Assembly of the Republic of Slovenia adopted the Whistleblower Protection Act (Official Journal of the Republic of Slovenia, No 16/23; hereinafter: the "Whistleblower Protection Act"). This Act transposes Directive (EU) 2019/1937 of the European Parliament and of the Council of 23 October 2019 on the protection of whistleblowers (OJ L 305 of 26 November 2019, p. 17; hereinafter: Directive 2019/1937/EU) into the legal order of the Republic of Slovenia.

In order to protect the public interest, the Whistleblower Protection Act sets out the methods and procedures for reporting and dealing with infringements of law of which individuals become aware in the working environment, and the protection of individuals who report or publicly disclose information about an infringement. Whistleblower Protection Act also sets out the powers of the Commission for the Prevention of Corruption and the safeguards and support measures to prevent or eliminate retaliation.

The main purpose of the Whistleblower Protection Act is to ensure that whistleblowers are protected from any reprisals by employers or other parties involved who may wish to cover up irregularities or illegalities. The law provides that it is prohibited to punish, dismiss or in any other way prejudice a whistleblower who has reported irregularities or breaches of the law.
