Whistleblowers Expose Secret ICE Policy Authorizing Warrantless Home Entries - sjodaily.com

Two anonymous government officials have disclosed a secretive Immigration and Customs Enforcement policy that authorizes federal agents to forcibly enter private homes without a judicial warrant. The disclosure was revealed Wednesday through legal nonprofit Whistleblower Aid and first reported by the Associated Press.

The policy, outlined in a May 12, 2025 memorandum signed by Acting ICE Director Todd Lyons, permits immigration officers to use “a necessary and reasonable amount of force” to enter residences based solely on administrative warrants.

Despite being addressed to “All ICE Personnel,” the memo has been shared only with select officials in what whistleblowers describe as an unusually secretive rollout for an unclassified document. According to the complaint submitted to Congress, supervisors have shown the memo to certain employees, allowed them a few minutes to read it, then required them to return it without taking notes or keeping copies.

More troublingly, whistleblowers report that instructors at the Federal Law Enforcement Training Center have been directed to verbally teach new ICE recruits that Form I-205, an administrative warrant of removal signed by ICE officials, authorizes forced entry into homes, even though written training materials explicitly state the opposite.

The policy change contradicts not only Supreme Court law but also DHS’s own historical positions and current training materials.
