Whistleblowers Say Major Outsourcing Company Engaged in “Cover Up” to Hide Visa Fraud - Federation for American Immigration Reform

Last week, Bloomberg News published allegations by three former employees of Tata Consulting Services who say the company gamed the L visa program in order to hire more guest workers in the United States.

The L-1A visa for managers is the visa program implicated in the whistleblowers’ allegations. The L visa program was created by Congress to allow transfers of personnel from a company’s overseas office to its offices in the United States. There are two different L visa classifications: the L-1A visa is for executives and managers and the L-1B visa is for workers with “specialized knowledge” relating to the organization’s work.

According to the three whistleblowers, Tata Consulting Services (TCS) misused the L-1A visa to circumvent the more stringent rules of the H-1B program, allowing the company to hire more workers than it otherwise could under U.S. law. Then, according to the whistleblowers, TCS tried to cover it up.

One of the whistleblowers, Anil Kini, told Bloomberg that the day before Trump was inaugurated, he was asked to change TCS’s organizational chart to make it look as though the company had more managers than it did. Mr. Kini said TCS feared that the new Trump administration, which had promised increased protections for American workers, would audit the company’s documents.
