Whistleblowers Took Too Long to Serve Hospital, 6th Cir. Affirms - Bloomberg Law

Two whistleblowers failed to revive their False Claims Act suit against Michigan-based Oakland Physicians Medical Center because they didn’t provide timely service of process, according to the Sixth Circuit.

Whistleblowers Mohamed Sy and Doshaun Edwards had 90 days under the federal rules of civil procedure to effectuate service of process once their FCA suit was unsealed. But they didn’t serve Oakland Physicians until about 50 days after that deadline passed, Judge Ronald Lee Gilman of the US Court of Appeals for the Sixth Circuit said in an Aug. 12 opinion.
