BOSTON — Sig Sauer and Cambridge, Massachusetts lost their motions for summary judgment on the lawsuit brought by a policeman who was denied promotions after he spoke publicly about his P320 pistol’s safety issues following an incident where it malfunctioned and discharged when he didn’t intend it to. His breach-of-warranty claim against the gun maker may proceed, and though Cambridge says his remarks about the pistol’s safety and his refusal to accept discipline for the discharging are two separate issues, the court agrees that both are part of a “continuous course of conduct.
