A Lyndhurst, Ohio woman previously exonerated on charges of making false sexual assault claims has now filed a federal lawsuit against two people involved in the case.
Arica Waters, 29, is suing Ottawa County Sheriff Stephen Levorchick and former deputy sheriff Amy Gloor for $500,000, alleging that they shared sexually explicit photos of her without her consent during the sexual assault investigation.
The investigation came after Ms. Waters alleged that Jeremy Berman, a former volunteer Put-In-Bay police detective, raped her after a house party in July, 2020. Ms. Waters was also employed with the Put-In-Bay police at the time as an officer for the summer season.
After an internal investigation, the police department took Ms. Waters to court in Ottawa County, where the Ohio attorney general prosecuted her on two counts of making false alarms, one felony and one misdemeanor. The case came to a close in December, 2021 when a visiting judge found Ms. Waters not guilty on both counts.
During the trial in Ottawa County Common Pleas Court, retired Judge Janet Burnside clarified that it was not up for her to decide whether there was consent between Ms. Waters and Mr. Berman, just if Ms. Waters knowingly made a false report.
Though the lawsuit relates to the same incident, the complaint filed July 5 in U.S. District Court in Toledo alleges a gross mishandling of private information and a violation of Ms. Waters’ 14th Amendment rights.
