A Woodbridge fire department employee alleges he and other firefighters were not paid overtime after working more than 40 hours in a workweek, according to a class-action lawsuit filed in Middlesex County Superior Court.
David Hines, who is assigned to a township firehouse, filed the civil lawsuit on behalf of himself and other similarly situated employees against Woodbridge Fire District No. 1, its commissioners and officers. The suit alleges they were denied overtime compensation in violation of the New Jersey Wage and Hour Law.
The lawsuit was filed in late June by attorney James Mets, whose Woodbridge law firm specializes in labor and employment law.
Court records indicate the complaint was served June 29 on a person authorized to accept service at the office of the Woodbridge Fire District No. 1 treasurer. The fire district has not yet filed a response.
While the lawsuit identifies Hines as a firefighter or fire officer, the Woodbridge Township Professional Firefighters Association's Facebook page lists him as a battalion chief and president of Local 290.
According to the complaint, Hines and the other proposed class members were paid under collective bargaining agreements.
The lawsuit alleges the terms and implementation of those agreements violated the New Jersey Wage and Hour Law because employees were not paid overtime after working more than 40 hours in a workweek.
