State Rep. Bob Donovan says Xperience Fitness may have violated the law by not giving employees 60 days notice when the gym chain abruptly closed all its locations in Wisconsin last week.
Donovan, a Republican state legislator, said Tuesday night he has spoken with the legislative liaison at the Wisconsin Department of Workforce Development and they "will be looking into this."
Xperience Fitness has a location within Donovan's district in Greenfield. "I certainly am concerned that they apparently have not followed the law as it relates to giving 60 days notice to these employees," he said.
The company sent an email to members on Thursday saying all gyms would be permanently closed in the state effective that same day at 9 p.m. Some members didn't get the notice until they showed up at the gym and saw a note hanging on the door.
Kate Schoen, who was a trainer at the Brookfield location, she said the only communication the company made to employees was to announce a meeting at 6:30 p.m. Thursday at which employees were informed the gym was closing. There was no 60 day notice given to employees, she said.
Donovan also said he also heard from employees that no 60 day notice was given. Without it, because more than 100 employees were impacted, Xperience may be in violation of the WARN Act, a federal law that requires a 60 days notice for employers laying off workers, Donovan said. State law also says employers with 50 or more employees must give 60 day notice for layoffs
