Foley partner Lisa Noller, Chair of the Firm’s Litigation Department, will be speaking at the American Bar Association’s Qui Tam & Civil False Claims and Healthcare Fraud Institute in Washington, D.C. from May 27-28.
On Wednesday, May 27, Noller will moderate the panel “Healthcare Fraud Enforcement,” which will discuss how health care remains the biggest source of U.S. Department of Justice (DOJ)- and Relator-generated False Claims Act (FCA) cases, year over year. The panel will feature former federal prosecutors who focused on FCA cases during their career at DOJ, and private sector attorneys will share their experience on both sides of an FCA case. On Thursday, May 28, Noller will be a panelist on the session titled “Foundations of Health Care Fraud; Stark Law, Anti-Kickback Statute, Eliminating Kickbacks in Recovery Act and Federal Administrative Sanctions; Criminal, Civil and Administrative Liability.”
This session will examine the Stark Law, the Anti-Kickback Statute and the Eliminating Kickbacks in Recovery Act and Exclusion and Civil Money Penalties and applications in various Health Care Fraud enforcement matters and include:
- An overview of each law and how it has been enforced in criminal, civil and administrative enforcement matters.
- The relationship between violations of these laws and liability under the United States False Claims Act.
- An overview of recent enforcement actions and potential defenses and approaches for mitigating risk.
