1 What are the most important new developments in your jurisdiction over the past year in employment law?
The covid-19 pandemic that began in February 2020 has had a profound impact on employers. Because states enjoy significant sovereignty in managing their affairs, the United States’ approach to covid-19 has largely been patchwork, with states implementing their own rules and requirements regarding stay-at-home orders, paid time off, mask mandates and the like, with limited overarching federal directives. While, in recent months, many jurisdictions have eased these restrictions, the rise of the Delta variant (including among vaccinated individuals) has forced many employers to re-evaluate their return-to-workplace plans, including giving increased consideration to vaccine mandates for their workforces, adjusting ‘reopening’ dates, and expanding remote work policies.
