The Bureau of Alcohol, Tobacco, Firearms and Explosives must face a race discrimination case brought by an officer who was involuntarily transferred after his Black supervisor allegedly made comments reflecting stereotypical views of Asians, a federal court in Washington, D.C. ruled.

Tommy Ho sufficiently alleged a race discrimination claim, and the need for additional discovery, the US District Court for the District of Columbia ruled Sept. 17. The court granted the agency dismissal of his retaliation claim, saying Ho failed to prove that an offer to settle an equal employment opportunity claim constituted an adverse employment action.
