BioReference Health, OPKO Health Settle False Claims Violations - Bloomberg Law

BioReference Health and OPKO Health agreed to pay $704,349 to resolve violations of the False Claims Act arising from BioReference’s submission of claims for laboratory tests that had not been ordered by a patient’s provider, the Justice Department announced Friday.

According to the DOJ, BioReference and OPKO knowingly submitted false claims to federal health-care programs for blood tests that were not medically necessary. From 2012 to 2023, the companies routinely performed more expensive tests when, in fact, medical providers had ordered less expensive tests, and then billed federal health-care programs for the more expensive and medically unnecessary tests.
