Blue Diamond Growers is free for now of allegations that it failed to pay almond processing plant workers for all of their hours, but a federal judge gave the plaintiffs permission to try again.
The workers’ allegations aren’t sufficient to support their claims that the tree nut company violated federal and state wage-and-hour laws, but they deserve a “final opportunity” to fix up their complaint with additional facts, the US District Court for the Eastern District of California said.
