California State Sen. Sabrina Cervantes filed a government claim Monday against the city of Sacramento, alleging "egregious misconduct" by members of the Sacramento Police Department, according to her attorney.
It stems from May 19, when Cervantes was cited on suspicion of driving under the influence of drugs following a crash at 14th and S streets when she was on her way to work at the Capitol. She suffered minor injuries in the collision.

Officers at the hospital said they saw signs of intoxication and conducted a DUI investigation that led to Cervantes being cited, police said, without getting specific. Officers later clarified she did not show signs of being drunk or under the influence, specifically of alcohol.
Cervantes has maintained her innocence since then, and toxicology results from a blood sample tested negative for "any measurable amount of alcohol or drugs."
The legal action is the first step required before bringing a civil lawsuit, and seeks damages for false arrest, emotional distress and defamation. It also cites a California law called the Bane Act that forbids interference of someone's civil rights by violence, threat of violence, intimidation or coercion.
