California Supreme Court paves way for Sonoma County law enforcement watchdog IOLERO to investigate whistleblower claims about Sheriff’s Office - The Press Democrat

After a yearslong legal battle, Sonoma County’s law enforcement watchdog can move forward with independent whistleblower investigations after the California Supreme Court declined to review a challenge by the Sheriff’s Office and a deputies’ labor group.

The Independent Office of Law Enforcement Review and Outreach, or IOLERO, sued the Sonoma County Sheriff’s Office in July 2024 over the department’s refusal to cooperate with subpoenas as the watchdog agency attempted to investigate whistleblower claims involving at least four Sheriff’s Office employees.

It was IOLERO’s first attempt to exercise major new powers expanded by voters in 2020 through Measure P. The local initiative was passed in a landslide but has led to years of legal wrangling and public debate over its implementation.

The Sheriff’s Office and the Deputy Sheriffs’ Association had argued in court that labor agreements between deputies and IOLERO limited the watchdog’s ability to handle whistleblower cases. They further claimed a 2021 state law giving counties broad authority to establish oversight bodies with subpoena power did not apply.

While a Sonoma County Superior Court judge sided with law enforcement in 2024, an appellate court reversed the lower court’s major findings in March, affirming IOLERO’s powers locally and strengthening oversight of sheriff’s departments statewide, according to advocates who have been closely watching the case.
