CAPE ELIZABETH, Maine —
Federal Department of Labor officials have recovered more than $36,000 in back wages from the owners of C Salt Gourmet Market in Cape Elizabeth.
The employers also had to pay nearly $15,000 in civil penalties for the violations involving minor-aged employees.
Labor Department investigators with the Wage and Hour Division also found that ten 14 and 15-year-old workers were allowed to work past federal legal limits.
Several of those minor-aged workers were allowed to use and clean equipment required by federal law to be operated by workers aged 18 and older - including an oven, non-automated deep-fat fryer and a power-driven meat slicer.
Federal investigators discovered that the managers did not pay workers proper overtime and that managers were also improperly included in the 86 employees' tip pool.
"An employer cannot keep employees’ tips under any circumstances," the Department's statement reads. "Managers and supervisors also may not keep tips received by employees, including through tip pools."
The rule applies even if tipped hourly workers are paid equal to or above full minimum wage.
