Carroll College will again face a golf coach’s Title IX retaliation claim after the Ninth Circuit ruled Thursday that refusal to renew a contract may be an adverse employment action.

Plaintiff Bennett MacIntyre may pursue his claim that he was retaliated against for complaining about gender inequality in the athletic department because the non-renewal of an employment contract is “likely to deter a reasonable employee from reporting discrimination,” the US Court of Appeals for the Ninth Circuit ruled in an opinion written by Judge Kenneth K. Lee.
