The Tenth Circuit upheld an arbitrator’s award in favor of an over 60-year-old sales director on her Age Discrimination in Employment Act claim against Dex Media, Inc., after the company demoted her from director to sales representative and voiced a preference for younger employees. Dex Media claimed that the arbitrator violated the parties’ arbitration agreement by disregarding the but-for causation standard and exceeded her powers by insufficiently explaining her findings and conclusions.
