Novartis Pharmaceuticals Corp. is entitled to summary judgment on a 67-year-old sales representative’s claims of age discrimination in violation of the Age Discrimination in Employment Act and disability discrimination in violation of the Americans with Disabilities Act Amendments Act alleging she was terminated the day after returning from medical leave, a Kansas federal court ruled. Although the sales representative presented sufficient evidence showing that at least two younger employees were treated more favorably for engaging in the same misconduct, she failed to demonstrate that her termination—for violating the company’s conflict of interest and gift policies—was pretextual, the court stated.
