An Alabama federal district court denied AlaTrade, Inc.’s motion to dismiss a terminated 69-year-old poultry plant employee’s discrimination claims under the Age Discrimination in Employment Act. He alleged that AlaTrade manufactured medical reasons to turn him away from his job, and ultimately terminated and replaced him with a substantially younger employee. The court found that he properly alleged that he was replaced by someone substantially younger and wasn’t required to allege or prove that he was subjected to discrimination by someone outside of the protected age range.
