A Virginia federal district court denied KBR, Inc.’s motion to dismiss a class of kitchen workers’ claims of unpaid overtime wages under the Fair Labor Standards Act, finding that the workers didn’t waive their right to assert their FLSA claims simply because KBR made payments to them and that they may pursue their claims even if they performed work that was subject to the Service Contract Act.
