City man files federal civil action against county detective on false ... - Williamsport Sun-Gazette

A Williamsport man can proceed with a civil action contending a Lycoming County detective made a false arrest against him in his individual capacity and violated his constitutional rights under the Fourth Amendment.

U.S. Middle District Magistrate Judge William Arbuckle will hear the lawsuit by Charles Johnson versus county Detective Stephen J. Sorage, following Johnson’s action initially filed on Oct. 3, according to court documents which had an update on the case moving forward this week.

The case was originally heard by Judge Malachy Mannion who remanded it to Arbuckle.

The Fourth Amendment provides for the right of the people to be secure in their persons, houses, papers and effects against unreasonable searches and seizures. That they shall not be violated, and no warrants shall issue, but upon probable cause, supported by oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.

Johnson’s complaint opens with an incident that took place three years ago when his son was struck in the face by his mother. Johnson and his son have had no contact with the mother since that incident.

Johnson was informed that the mother would be going to trial on this prior April 20, which he planned to attend.

The assistant district attorney, as is typical, sent Sorage and a second detective to Johnson’s house and eventually Johnson was served a subpoena. Johnson was visited a few days later, handcuffed and questioned about not...
