For New Jersey educational institutions in particular, the case may represent an early indication that courts will expect greater procedural integration across compliance, disciplinary and labor systems moving forward.

“The court misapprehended the law when it bifurcated the matter and compelled arbitration of the race-based claims because they are a part of plaintiff’s case and relate to her sexual discrimination claims; having arisen from her sexually harassing employment relationship,” the Appellate Division ruling stated.
