Constitutional Court Upholds Obstruction Charges, Elderly Employment Act in Shinhan Bank Case - 조선일보

A constitutional complaint filed by former Shinhan Bank personnel and recruitment officers implicated in the 2013–2016 ‘Shinhan Bank Hiring Irregularities’ case, challenging the constitutionality of obstruction of business charges and the *Act on the Prohibition of Age Discrimination in Employment and the Promotion of Employment of Older Persons* (Elderly Employment Act), was dismissed by the Constitutional Court, which ruled both provisions constitutional.

According to legal circles on the 2nd, the Constitutional Court unanimously upheld the constitutionality of the obstruction of business charge under Criminal Act Article 314, Paragraph 1, in a ruling on the 29th of last month. Regarding the Elderly Employment Act, the court ruled 7–2 in favor of constitutionality.

The core allegations against Kim and Lee, the former Shinhan Bank personnel, involved creating and managing lists that classified applicants as either “special candidates” (those recommended by lawmakers, influential figures, or Financial Supervisory Service employees who could influence the bank’s operations or supervision) or “children of executives” (offspring of department heads or higher-ranking Shinhan Bank employees).
