A new class action lawsuit alleges CVS falsely advertises its toddler cleansing wipes as hypoallergenic despite the presence of added fragrance, a known allergen.
Plaintiff Frankie Walton filed the class action complaint against CVS Pharmacy on July 9 in California federal court, alleging violations of state and federal consumer laws.
Walton claims CVS prominently markets its store-branded toddler cleansing wipes as hypoallergenic, a term that suggests the product is free from unnecessary ingredients that could cause allergic reactions.
However, the class action lawsuit alleges that the wipes contain added fragrance, a common allergen that serves no cleansing, preservative or stabilizing function.
The lawsuit argues that consumers, particularly those with sensitive skin or parents purchasing products for their children, are willing to pay a premium for CVS toddler wipes because they believe these products have been formulated to minimize the risk of allergic reactions.
The complaint cites data from the Centers for Disease Control and Prevention, which reports that approximately 12% of U.S. children — and more than 14% of children aged 0 to 4 — have reported skin allergies.
