Dish Network Whistleblower Urges Court to Recognize US Bad Faith - Bloomberg Law News

The whistleblower accusing Dish Network Inc. of defrauding the Federal Communications Commission in a license auction urged a federal district court to allow the 10-year suit to continue despite the government’s wishes to the contrary.

Vermont National Telephone Co. said Thursday that a US magistrate judge based his recommendation to dismiss the False Claims Act suit on an erroneous interpretation of a US Supreme Court decision, and that he didn’t properly consider evidence of government’s “bad faith” in its decision to seek dismissal.
