The Department of Justice (DOJ) has announced a new white-collar enforcement plan (“Enforcement Plan”) titled, "Focus, Fairness, and Efficiency in the Fight Against White-Collar Crime," which emphasizes efficiency in investigations, prioritizes prosecuting senior-level misconduct, and introduces significant revisions to existing policies regarding corporate enforcement and self-disclosure and monitorships
The Enforcement Plan identifies ten high-impact areas of focus, including waste, fraud, market manipulation, national security threats, and digital asset crimes. These areas reflect both traditional enforcement priorities and new concerns related to foreign entities
Policy revisions include changes likely to result in (i) more Corporate Enforcement Policy declinations and (ii) a narrowing of the imposition of monitorships, and when imposed, greater oversight by the Department over compliance monitorships, as well as (iii) an expansion of the Corporate Whistleblower Awards Pilot Program to cover additional areas of importance to the Administration
