DOJ Antitrust Division's New Whistleblower Program Signals Pipeline for Investigations Outside of Leniency - Law.com

On July 8, 2025, the Department of Justice (DOJ) Antitrust Division announced a new Whistleblower Program in partnership with the U.S. Postal Service (USPS) to offer monetary rewards to individuals who report antitrust crimes and related offenses through an online reporting portal. The Division’s new Whistleblower Program provides an eligible whistleblower an opportunity to receive 15% to 30% of any recovered criminal fine of at least $1 million resulting from his or her information. In a Sherman Act case—the primary statute the division enforces—the maximum criminal corporate fine is $100 million, though the maximum fine can increase to twice the amount gained by the defendant or lost by the victim. 15 U.S.C. § 1. Therefore, a whistleblower award could provide substantial monetary incentive to reporting criminal violations. This announcement follows the DOJ Criminal Division’s Corporate Whistleblower Awards Pilot Program implemented in August 2024 and is in line with DOJ's overarching recent push to incentivize self-reporting.
