Summary
A St. Louis County Court’s judgment in an employment discrimination case was affirmed by the Missouri Court of Appeals Eastern District. It ruled that the lower court correctly determined an employee of the St. Louis County Department of Public Health was not discriminated against.
The employee, Mihretu Ayalew, now has the opportunity to appeal the decision to the state supreme court.
The two-page per curiam opinion stated the county did not discriminate against Ayalew by “failing to promote or by failing to provide him just compensation.”
Ayalew claimed he was discriminated against based on his race and nationality as a Black, Ethiopian man. He said the county failed to promote him and to provide just compensation to him in his role with the health department.
“Plaintiff had applied for 40+ promotions to supervisory positions, many of which he was clearly not qualified for,” according to the St. Louis County Counselor’s Office. “He received interviews on several (first and second interviews) but ultimately did not get selected for those positions.”
Ayalew raised four points in his appeal, and the court considered his first two which had to do with instructional error in “refusing to provide a second verdict director provided by plaintiff pursuant to MAI 19.01,” according to the county counselor’s office.
