EEOC sues Supreme Staffing, alleging employment discrimination - The Business Journals

The U.S. Equal Employment Opportunity Commission (EEOC) has filed a lawsuit against three connected Memphis-based staffing agencies.

The EEOC brought the lawsuit against the "integrated enterprise" of Supreme Staffing LLC, Inspire Hotel Staffing LLC, and Better Placements LLC, which are owned by Eduardo Sanchez Borja.

In one count, the defendants are alleged to have engaged in a "standard operating procedure" of "unlawful employment practices [that] disproportionately exclude Black employees from employment and constitute a pattern or practice of discrimination against Black employees based on race," the complaint said.

Supreme Staffing, Inspire Hotel Staffing, and Better Placements "selected, referred, placed, and assigned Hispanic employees for clients at a disproportionately higher rate than Black employees," the EEOC alleged.

Sanchez Borja did not respond to MBJ's request for comment.

According to the court filing, "While the labor market availability for Black workers in the Memphis Metropolitan Area was approximately 93% and 6% for Hispanic workers during the relevant period, Defendant Employers placed approximately 5,600 Black workers when they should have referred or placed over 9,000 Black workers, and placed over 4,000 Hispanic workers when [they] should have referred or placed under 600."

The complaint names several individuals who allegedly applied for positions they had experience for, but were not selected for employment, or were placed in lower-paying jobs.
