WAUKESHA - Kathleen Cummings, the former alderwoman charged with seven felonies for allegedly falsely declaring she lived within her district, is scheduled to appear in court June 1 for the first hearing since her not-guilty pleas.
At an arraignment hearing on Tuesday, Cummings formally pleaded not guilty to the charges in Walworth County Circuit Court in Elkhorn, where most of the proceedings are being held to avoid a potential conflict of interest involving Waukesha County public officials.
The longtime Waukesha County elected official, who served as both a county supervisor and a city alderman until her resignation in November 2021, has been charged with five counts of false swearing in a government setting, each tied to separate oaths she took between 2015 and 2019, and two counts of election fraud in falsifying nomination-related documents.
In a criminal complaint filed Nov. 10, authorities claimed Cummings resided in a second home about a half-mile away from the Robert Avenue residence listed on election forms. The problem is that the second residence, on Downing Drive, was outside her aldermanic boundaries for District 9.
Authorities used utility records and information from postal officials to try to establish at which residence Cummings, along with her husband, David, were actually living, though they owned both homes and lived in both at different times.
