GRAND JUNCTION, Colo. (KKCO) - On September 20, the U.S. Equal Employment Opportunity Commission (EEOC) filed a lawsuit against Montrose Regional Health (MRH) for age discrimination and retaliation for the second time.
According to the lawsuit, older nurses in the Same Day Surgery/Post-Anesthesia Care Unit (SDS/PACU) were allegedly harassed by two managers, including the chief nursing officer.
“There were several witnesses who said that there were comments made by two high-level managers. Things like, ‘we need younger nurses [to] take over this unit,’ ‘We need more youthful, more energetic staff’, and they made derogatory comments about older nurses,” said Mary O’Neill, Regional Attorney for Phoenix District at EEOC.
According to the suit, when older workers complained about discrimination, MRH allegedly failed to address their complaints and allegedly fired multiple workers in retaliation.
“Unfortunately, in this situation, older workers, older nurses were being treated unfairly in our belief. That’s our allegation in this case, and that’s what our investigation showed. So, we’re going to go forward and vindicate the rights of these older nurses,” said O’Neill.
The alleged conduct violated the Age Discrimination in Employment Act and Title VII of the Civil Rights Act of 1964.
