The Office of Personnel Management (OPM) has issued a proposed rule that would revise its regulations governing administrative leave, resignation withdrawals, and related workforce management practices. The proposal would codify existing policies, establish new prohibitions and illustrative examples for administrative leave, and reinforce agency discretion in administering such leave. It also would clarify agencies’ authority to deny resignation withdrawal requests, particularly in deferred resignation programs, and permit administrative leave during reduction-in-force notice periods.
Proposed regulatory framework. The proposed rule would amend regulations in 5 CFR parts 351, 630, and 715 to more fully address the appropriate uses of administrative leave, including in connection with deferred resignation programs and workforce realignment initiatives. OPM stated that the changes are intended primarily to codify existing policy guidance and provide a clearer regulatory foundation for agency practices.
OPM proposes revising terminology in administrative leave regulations to replace “grant” with “provide,” emphasizing that such leave is not typically employee-requested and may be imposed without consent, such as during investigations.
