The US Supreme Court declined to consider whether former FedEx Corp. employees who live and worked outside of Pennsylvania can opt into a federal collective action accusing the multinational shipping company of robbing them of overtime pay.
The justices’ decision Monday to pass on the case leaves in place the issue of whether a federal judge can allow out-of-state plaintiffs to join a Fair Labor Standards Act collective action even though their claims aren’t connected to the defendant’s activities in the state where the suit was filed.
