New Delhi: Labour laws are meant to safeguard the interest of labourers but it is seen that it is being misused and it has become a track to extort money from managements, a Delhi court observed while dismissing an application filed by a man against Nathu Sweets claiming he was an employee there and was entitled to overtime wages.
The trend of filing false claims is very disturbing because it will hamper the work of business establishments, said Ajay Goel, presiding officer of the labour court.
The court noted that the workman has not been able to produce anything to substantiate his claims that he was employed by the business management and was entitled to overtime wages. “The management in these circumstances will be crippled and will be cautious in taking the workman in its employment if this fear persists that any person can drag him to the court. Simultaneously, the workman will also lose his employment opportunity,” the court said in an order on June 1.
It said, evidence showed that workman was not a regular employee and as per his own version, his services might have been taken on contract basis only.
