Fiskars Ordered to Pay $1.4 Million to Woodland Tools in False Advertising Claims - Hardware Retailing

In a lawsuit between two competing garden tool manufacturers, Woodland Tools Co. and Fiskars, the Federal District Court for the Western District of Wisconsin found Fiskars Brands Inc. and Fiskars Finland Oy Ab liable for false advertising.

The court ordered Fiskars to pay over $1.4 million to Woodland Tools, adjust its packing of fourteen popular gardening products and remove cutting power claims and false statements regarding design origins proven to be misleading.

“As an emerging brand in the market, we are grateful that measures are being taken to protect consumers from deceptive advertising, in this case, perpetuated by one of the oldest companies in the world, Fiskars,” says Mike Kollman, president and co-founder of Woodland Tools.

In ordinance with the lawsuit, Fiskars must make the following changes:

  1. Fiskars must not state “Designed by Fiskars in USA” on the product packaging or on any advertising of Fiskars 9117 Pruners and Fiskars 9688 Pruners.
  2. Fiskars must not make any Ambiguous Quantified Comparative Cutting Power Claims, such as “up to three times more power,” that do not disclose the base of comparison, on any product packaging or advertising of any Fiskars products listed here.

Additional changes Fiskars must follow are outlined in the court order.

All claims filed against Woodland Tools by Fiskars were dismissed and upheld claims made by Woodland Tools were taken to trial. The jury’s unanimous verdict stated Fiskars had engaged in multiple counts of...
