MILACA — A former City of Milaca employee has filed a whistleblower lawsuit against the city following his termination.

According to a complaint filed Oct. 1 in Minnesota District Court, the employee reported multiple safety concerns and potential unlawful conduct by co-workers that went unaddressed by city officials. He was later terminated in connection with those reports.

The plaintiff, Mark Wubben, was hired as a seasonal park maintenance worker in 2015 and became a full-time employee in the city’s Public Works Department two years later.

Over the next several years, Wubben raised multiple safety concerns with his supervisor, including unsafe chemical handling, confined-space entries without proper equipment, and sewer access without gas detection devices.

The complaint also states that Wubben reported a co-worker for allegedly stealing a tailgate from a vehicle impounded in the Milaca Police Department parking lot and installing it on his personal vehicle. Wubben said he reported the theft to his supervisor, but no action was taken, and city leaders — including the city manager, council and mayor — were not notified.

Following his reports, Wubben said he experienced retaliation from other city employees, including his supervisor, and was assigned undesirable job duties.

Wubben later reported both his safety concerns and the alleged retaliation to City Manager Tammy Pfaff, who allegedly told him, “Hopefully things will get better… or it could get worse.”
