Former OPM employees impacted by RIFs are asking the Merit Systems Protection Board to treat their case alleging a violation of RIF rules as a class action.

Federal employees who were caught up in the Office of Personnel Management’s reductions in force (RIFs) earlier this year allege that OPM violated RIF rules when it terminated their positions.

Former OPM employees are asking the Merit Systems Protection Board to treat their case as a class action. They allege the Trump administration is attempting to move multiple roles OPM eliminated during RIFs to the General Services Administration — a move that runs counter to RIF regulations.

“The government is entitled to conduct RIFs, but they are an option of last resort, and they need to be conducted according to the regulations governing RIFs and based on a bona fide reason. And that just does not seem to be the case here,” Chloe Barrett, an associate at Gilbert Employment Law — the law firm representing employees in the MSPB case — said in an interview with Federal News Network.

Although no clear merger plan has taken shape, Federal News Network reported in February that GSA senior leaders had been discussing the Trump administration’s long-term goal to merge GSA, OPM and the Office of Management and Budget into a single agency.
