A former employee of SpaceX has filed a wage and hour class action against the spacecraft engineering company, accusing them of violating California labor laws. The worker, Juan Padilla, claims that SpaceX failed to pay proper wages, including minimum, straight time, and overtime wages, and also denied employees rest and meal breaks.

Padilla, who worked as a non-exempt employee from January to September 2022, alleges that SpaceX coerced employees into working off-the-clock without compensation and failed to accurately record hours worked. Furthermore, he claims that the company failed to timely pay final wages and reimburse employee expenses.

According to Padilla, SpaceX did not provide mandated meal breaks and rest periods, instead pressuring workers to perform tasks during these periods or denying them permission to take breaks. The lawsuit argues that the company’s policy and practices were not in compliance with California law.

This is not the first time SpaceX has faced labor violation accusations. In 2017, the company settled a $3.9 million lawsuit involving over 4,000 workers who claimed they were underpaid and denied rest and meal breaks. The previous lawsuit had similar allegations regarding work schedules and compensation.

Despite the settlement, concerns remain about SpaceX’s compliance with labor regulations. The company, founded by Elon Musk in 2002, holds valuable contracts with the US military and NASA. SpaceX currently employs nearly 10,000 people.
