A whistleblower’s False Claims Act suit alleging Medicare and Medicaid fraud against hospital Geisinger Holy Spirit and others is dismissed because it duplicated another suit, a federal district court said.
Whistleblower Jesse Polansky’s suit against Geisinger triggered the FCA’s government action bar, which precludes suits based on allegations that are the subject of a civil suit or an administrative civil money penalty proceeding in which the government is already a party, Judge Joseph F. Saporito Jr., of the US District Court for the Middle District of Pennsylvania said in a Wednesday order to dismiss.
