Actor Jamie Foxx has vehemently denied allegations of sexual assault made against him by a woman who filed a lawsuit on Wednesday.
A spokesperson for Foxx stated, "The alleged incident never happened... We are confident they will be dismissed again." The representative also revealed that Foxx plans to pursue legal action against his accuser, stating, "Mr. Foxx intends to pursue a claim for malicious prosecution against this person and her attorneys for re-filing this frivolous action."
The lawsuit, filed by a woman identified as Jane Doe, alleges that Foxx touched her inappropriately during an encounter at Catch NYC & Roof in August 2015. According to TMZ, the woman claims that Foxx placed his hands on her waist and then moved them under her top to rub her breasts. She further alleges that the assault escalated when Foxx put his hands into her pants and touched her vagina and anus.
The accuser also claims that there were witnesses present, including security guards, and has named the restaurant as a defendant in her suit. She alleges that she suffered emotional distress and had to undergo medical treatment as a result of the alleged assault.
While the incident reportedly occurred nearly a decade ago, the accuser was able to file her case under New York's Adult Survivors Act, which allows alleged victims of sexual offenses to file civil suits even if the statute of limitations has passed. The law is set to expire on Friday.
