Labor and Agents: Nassar to examine employment designation of tennis players - Sports Business Journal

hmad Nassar, the new executive director of the Professional Tennis Players Association, plans to take formal steps to determine if tennis players are employees or independent contractors.

Professional tennis players have long been classified as independent contractors, not employees. The distinction is important for a lot of reasons, foremost among them is independent contractors cannot unionize or engage in strikes or collective bargaining. Only employees can do that.

Nassar was named the first executive director of the PTPA in August. In a wide-ranging interview, Nassar said the independent contractors designation is something he plans to explore. He said that, based on his understanding, that designation has never been challenged. “So that structure that exists right now has not been stress tested,” he said. “No court, no independent judicial body, has had a challenge in front of it that squarely addresses that.”

Nassar plans to hire legal counsel to look into the matter. He said it is something that should be settled by the PTPA as it starts out on its mission of improving tennis players’ lives, but he added strongly that he is not taking sides on the outcome of the employee versus independent contractor issue.
