Maryland Becomes Tenth State To Enact Paid Family Leave Law - Employment and HR - United States - Mondaq

Seyfarth Synopsis: On Saturday, April 9, the Maryland General Assembly voted to override Governor Larry Hogan's veto of the Time to Care Act of 2022, enacting paid family leave in Maryland. Paid leave will be available to eligible employees for family leave, medical leave, and family military leave reasons beginning on January 1, 2025. Maryland is the tenth state to enact a mandatory paid family or paid family and medical leave program.1

Legislative Background

On April 9, 2022, the Maryland General Assembly voted to enact SB 275, the Time to Care Act of 2022 (the "Act"), creating a paid family and medical leave program for workers in Maryland. On March 31, 2022, SB 275 passed the legislature by a supermajority vote, but Governor Hogan vetoed the bill on April 8, 2022. On Saturday, legislators voted to override the veto by votes of 30-16 (Senate) and 94-44 (House).

Key Dates

The Act establishes a Family and Medical Leave Insurance Fund (the "Fund"), and instructs the Maryland Secretary of Labor to adopt regulations no later than June 1, 2023. Beginning October 1, 2023, employees, employers, and self-employed individuals must begin making contributions to the Fund.2 Covered workers can begin receiving benefits on January 1, 2025.3
