Workers who say Mercy Health and two related entities failed to provide proper meal breaks may conditionally pursue their wage-and-hour claims as a collective, a federal judge in Missouri said.
The hourly worker behind the suit—which accuses the health system of automatically deducting 30 minutes of pay per shift for required meal breaks employees often must work through—properly alleged that she’s similarly situated to others in the proposed Fair Labor Standards Act collective, the US District Court for the Eastern District of Missouri said.
