Missouri-based Saint Luke’s Health System Inc. and others stopped a whistleblower’s False Claims Act suit alleging that they engaged in an improper scheme to overcompensate cardiologists for patient referrals because the complaint lacked requisite particularity, a district court said Monday.
Whistleblower Jeffrey Kunin’s “conclusory and generalized” allegations of Medicare fraud don’t sufficiently plead facts giving rise to FCA liability, Judge Roseann A. Ketchmark of the U.S. District Court for the Western District of Missouri said.
Kunin attempted to plead fraud based on the particularities of Saint Luke’s compensation scheme rather than pleading representative examples of false claims, the court said. ...
