“Miya's Law” Requires Florida Landlords to Background Check Employees - ESR NEWS

On July 1, 2022, Florida Senate Bill 898 (SB 898) – also known as “Miya’s Law” in honor of Miya Marcano, a 19-year-old college student who was killed by a worker at the apartment complex where she lived in 2021 – will take effect and improve tenant safety in apartment buildings by requiring landlords of nontransient or transient apartments in the state to require employees to undergo background screenings as a condition of employment.

Under the law – which passed unanimously in the Florida House and Senate – an apartment building landlord must require that employees of the building undergo a background check performed by a consumer reporting agency (CRA) in accordance with the federal Fair Credit Reporting Act (FCRA) that must include a screening of criminal history records and sexual predator/offender registries of all 50 states and the District of Columbia.

Sponsored by Florida State Senator Linda Stewart (Democrat – Orlando) and Florida State Representative Robin Bartleman (Democrat – Weston), “Miya’s Law” would allow a landlord to disqualify a person from employment at their apartment building if the person has been convicted or found guilty of, or entered a plea of guilty or nolo contendere to, regardless of adjudication, any of the following offenses:
