MOX services agrees to pay $10 million to settle allegations of false claims - The Augusta Chronicle

MOX Services LLC has agreed to pay $10 million to resolve allegations that it knowingly presented invoices to the Department of Energy for non-existent construction materials.

According to a release by the U.S. Department of Justice, MOX allegedly and knowingly submitted false and fraudulent invoices for non-existent materials and received improper kickbacks, while being the prime contractor for the construction of the Mixed Oxide Fuel Fabrication Facility at the DOE Savannah River Site in Aiken. MOX was required to confirm receipt and acceptance from subcontractors of any materials before claims were approved and submitted to the DOE for those materials.

According to the release, one of the subcontractors, Wise Services Inc., submitted hundreds of invoices to MOX charging millions of dollars for materials that did not exist. Those false invoices were then presented to DOE by MOX, which knowingly failed to follow its own policies and procedures and violate their obligation to uncover that the Wise invoices were for non-existent materials.

MOX employees allegedly received kickbacks from Wise employees involved in the scheme, according to the release.

“It is vital that contractors on federally funded projects provide sufficient oversight of the companies they hire to ensure that the government is billed only for legitimate goods and services,” Principal Deputy Assistant Attorney General Brian M.
