Netherlands – Budget 2022 introduces mandatory certification system for temporary employment agencies - Staffing Industry Analysts
The Dutch government launched its Budget 2022, presenting a change in the law to introduce a mandatory certification system for temporary employment agencies. The change aims to prevent malpractices.
To be eligible for a certificate, agencies have to demonstrate adherence to the rules. Temp agencies will be regularly checked, for example on payment of the correct wages, and the proper filing of taxes.
Temporary employment agencies also must:
- have a certificate of conduct (VOG)
- pay a deposit of 100,000
- offer approved housing to foreign staff
If a temporary employment agency loses its certificate, it can no longer operate as a temporary employment agency.
It is expected this change will come into force on 1 January 2025.
Budget 2022 also introduced a change to the statutory minimum wage. The wage will go up by 10.15%. Benefits linked to the minimum wage, such as AOW (pension), welfare, and the Wajong (Young Disabled Persons benefit), will also increase. It is expected this change will enter into effect on 1 January 2023.
The government also announced that the private business ownership allowance (zelfstandigenaftrek) will be reduced sooner, to 900 in 2027. This reduction is for self-employed entrepreneurs that are eligible for the private business ownership allowance. It is not yet known when this change in law will come into force.
