New ABA employment disclosure protocols obscure law school-funded job positions - Derek T. Muller | Substack

I missed this memo last fall with respect to the ABA employment disclosures:

The significant changes to these Employment Protocols include:

1) The removal of the salary threshold as part of the exemption requirement for positions funded by the law school or university (directly or indirectly). Previously, law schools could be exempted from reporting positions funded by a law school or university if they met a certain renumeration threshold.

2) The removal of ‘university funded’ language when considering such positions.

3) The removal of a Law School Funded category in the Employment Status section of the Employment Summary Report and the removal of the word “University” from the Law-School/University Funded Positions section of the report.

The changes do two things. The first is that certain positions at a certain salary were “exempted” from “law school-funded” disclosures. We don’t have any data about who that effects, so let’s set that aside.

The second is the big one. In previous years, school-funded positions were specifically pulled out of the top-line employment data. Now, they are included, and a reader needs to back out that data if they want to compare data year-over-year.

This change obscures law school funded positions exist and how they relate to overall employment.
